  1. The permit issued on June 5, 2007 did not become effective because a timely petition for review of eth permit was filed with the USEPA’s Environmental Appeals Board (EAB) on July 10, 2007. The permit became effective on January 28, 2008 when the EAB concluded its review, supporting the issuance of the permit.
  2. The permit issued on April 28, 2005 did not become effective until the EAB concluded its review on August 24, 2006, supporting the issuance of the permit.
  3. The permit issued on August 10, 2006 did not become effective until November 21, 2006 when a petition for review of the permit filed with the EAB was officially withdrawn.
