Understanding Illinois' E-Waste Goal Formulas

Public Act 95-0959 - Electronic Products Recycling & Reuse Act

I.   Introduction

Sections 15-19 of the Act set forth the formulas the Illinois EPA will use in calculating manufacturers' annual recycling goals, which will be published in tons. To assist manufacturers in understanding the Act, a synopsis of the goal-setting procedure is below. There are different sets of procedures: one for the first program year (2010), one for the second (2011), and one for the third and all program years thereafter (2012 and beyond).

Please note that the Act only requires those manufacturers wishing to sell their electronic products in the State to register with the State, and pay the registration fee. However, the Illinois EPA will set an annual recycling goal for computer/monitor/printer manufacturers with past products represented in return share data--these manufacturers will not need to register or remit the registration fee.

The goals for each manufacturer for the first program year (2010) will be published by the Illinois EPA no later than October 1, 2009. Goals for succeeding program years will be published no later than October 1 of the previous year.

II.   Second program year (calendar year 2011)

  • Overall statewide goal--to be calculated in two steps.
    • (1) Illinois EPA will determine the higher of: the total weight of CEDs recycled or processed for reuse between January 1, 2010 and June 30, 2010 as reported by manufacturers, or as reported by recyclers.
    • (2) Illinois EPA will multiply the weight determined in step 1 by:
      • 90% if the weight is less than 90% of the goal computed for 2010
      • 95% if the weight is at least 90% of the goal computed for 2010, but less than 95%
      • 100% if the weight is at least 95% of the goal computed for 2010, but less than 105%
      • 105% if the weight is at least 105% of the goal computed for 2010, but less than 110%
      • 110% if the weight is 110% or greater of the goal computed for 2010
      • The result of this multiplication will be the statewide goal for 2011.
  • Share of the statewide goal assigned to television manufacturers: The percentage of the total weight of CEDs recycled or processed for reuse between January 1, 2010 and June 30, 2010 attributable to televisions as reported to Illinois EPA
  • Share assigned to computer/monitor/printer manufacturers: The percentage of the total weight of CEDs recycled or processed for reuse between January 1, 2010 and June 30, 2010 attributable to computers/monitors/printers as reported to Illinois EPA
  • Goal assigned to each television manufacturer will be based on market share data between January 1, 2010 and June 30, 2010 as reported by Illinois retailers
  • Goal assigned to each computer/monitor/printer manufacturer will be based on Illinois return share data between January 1, 2010 and June 30, 2010 as reported by manufacturers via sampling procedures outlined in Section 30(e) of the Act, and will include an identical proportion of orphan products identified in return share data.

III.   Third program year and beyond (2012 and going forward)

Manufacturer's goals will be based on a set percentage from sales data from two years prior to each program year.
