Illinois EPA Issues Court-Ordered Permits to Summit/McCook Proposed

Springfield, Ill. -- Pursuant to the order of the First District
Appellate Court, the Illinois Environmental Protection Agency today issued
state air and land construction permits to the West Suburban Recycling & Energy Center,
L.P. (WSREC). See the fact sheet for more
detail. The Illinois EPA originally denied WSREC's requests for the state
air construction and land development permits in February 1995. Subsequent
proceedings before the Pollution Control Board and the First District Court
of Appeals resulted in the mandate under which those permits were issued
today.
However, as a result of an order issued in March 1999 by the U.S.
EPA's Environmental Appeals Board, Illinois EPA has denied a proposed federal
Prevention of Significant Deterioration (PSD) air construction permit to
commence construction of the proposed incineration facility at a site in
the villages of Summit & McCook (Cook County).
The proposed municipal solid waste processing, recycling and incineration
facility cannot proceed without the PSD permit. The EAB questioned whether
the project is still viable since WSREC has sold some of the properties
underlying the proposed incinerator. WSREC has until Sept. 13 to appeal the denial to the
